Serving As Petitioner For P-1 And O-1 Visas For Passive Income

Every visa in the P-1  (Athletes and Music Groups) and O-1 (Musicians, Creatives, Entrepreneurs, Coaches, and more) categories requires a “petitioner” to sign off on the visa petitions. Under my sports agency, SDS Sports Group, I have made plenty of passive income by serving as the petitioner for visas when the visa applicant does not have another resource. 

Typically, we charge $1000 - $2000 per visa application to serve as the petitioner for the visa. 

The way we structure visa petitions, the petitioner is not responsible for providing any direct salary to the visa applicant. In most cases, the petition is structured so that the petitioner has no responsibilities besides the minimum required by United States Citizenship and Immigration Services.

The minimum requirements to serve as a petitioner for P-1 and O-1 are as follows: 

  • Petitioner agrees to receive service of process on behalf of the visa applicant

This means that the petitioner can accept the service of civil suits on the applicant, but they do not incur liability. 

  • Petitioner asserts that the contents of the petitioner are true

You want to make sure that the person you are petitioning is actually in the field they say they are. The consequence if they are found to be not using the intended status is the revocation of the visa by USCIS. 

  • Cost of reasonable travel back to the home country if the visa is terminated early

If there is no one else to pay, the petitioner is ultimately responsible for reasonable travel for the visa applicant if the petitioner terminates the visa early. We advocate contracting this portion of the responsibility to the visa applicant and someone overseas that is associated with them.

With the visa package, we will include all of the information necessary for you to serve as a petitioner. The best practice is also to have the client name a “foreign employer, " any person/entity overseas listed as the main responsible party on the visa to even further distance you from responsibilities on the visa.
