James Mcfadden Obtains A Three-Year Extension On His P-1 Status

We are glad to report yet another successful P-1 petition. We effectively petitioned for a three-year approval for Sprintcar superstar James McFadden’s P-1 status. James is an internationally renowned race car driver currently employed by Kasey Kahne Racing (KKR).

Managing Member of the firm, Sherrod Seward successfully presented the petition proving eligibility for the P-1 visa as an internationally known athlete to USCIS. He was also able to confirm that the races in which James would be participating as a car racer require the participation of international athletes.

The Athlete:

James is a world-class motorsports athlete that has gained enormous regional and international respect in local and international championships.

The Petitioner:

Kasey Kahne Racing is a motorsport team based in Mooresville, North Carolina. It was founded in 2005 by Kasey Kahne, a NASCAR driver. The team has more than 15 members devoted to sprintcar racing. Kahne is a direct employer of James McFadden.

The P-1 Petition - Eligibility Requirements:

To meet the requirements by the USCIS, Kasey Kahne Racing was the petitioner in this petition. We were able to demonstrate that KKR would like to extend the P-1 status upon James McFadden, whom they consider to be a world-class driver.

In the petition, we presented James as the world-class athlete he is by revealing his participation in international races. We were able to give details and competition itinerary for the athlete. We also confirmed that James would be taking part in international races with racers befitting his global ranking and skill level.

To add weight to our case, we also revealed that the beneficiary’s skill level and the rank was far beyond that of most American racers. Therefore, he would have to participate in international races competing with other international athletes of his class and skill level.  

We informed the USCIS that highly ranked American racers require other highly rated racers to compete against. Competing against international racers would allow them to move up in global rankings.

4. Australian Sprintcar Team (2014), where James McFadden took series honors for Australia.

International Rankings of Sprint Car Racer

The firm also provided evidence that the athlete is ranked internationally to demonstrate that the beneficiary has a reputation beyond a single country. We presented the following international accolades for the athlete:

  1. James McFadden is rated #1 in the sport as per the World Series Sprintcars. He has won the World Series Sprintcars five times.

  2. He is also ranked first on the Final 2019 Jesse Hocket “Mr. Sprint Car” top ten standings. He earned the award after winning the most points in more than 10 nights of racing in Central Iowa in August.

  3. James ranks 24th in the 2019 World of Outlaws Standings.
