EB-1A Visa Pricing & Process

Legal Fee Quotation

The legal fee portion of your visa petition is $10,000. This fee represents the total legal fees required to draft and complete your visa petition brief, exhibits, and forms for the EB-1A portion of this process.

Payment for legal fees are charged in advance and other fees are charged as they become applicable during the process. For payment plans, clients are invited to explore Build Your Dreams for financing.


Government Fee Options

USCIS Regular Processing Government Fees

  • The filing fee is $715 and typically takes 8-12 months to receive a response.

  • There is also a $300 dollar asylum fee for each petition.

  • The Total regular processing fee is $1,015.

USCIS Premium Processing Government Fees

  • The filing fee is $3,615 for 15 business-day responses. Note that premium processing is not recommended if the client plans to simultaneously apply for an adjustment of status for permanent residence.

Permanent Residence - Green Card Processing

You will need to decide between these three options for obtaining Permanent Residence (“Green Card”) along with obtaining Approval for EB-1A:

  1. If in the United States, apply for adjustment of status along with your EB-1A visa at the time of filing. If you are doing this option, you should consider regular processing for the EB-1A.

  2. Apply for the adjustment of status while in the United States after the approval of the EB-1A.

  3. If outside the United States, apply for consular processing of Permanent Residence after the EB-1A is approved.

Additional Aplications and feeling fees

  • Standard Fee: $1,440 for applicants filing standalone applications.

    Age-Specific Fees: Different fees may apply for applicants under the age of 14, typically lower to accommodate younger applicants.

    Additional Applications:

    Form I-131 (Travel Document): Necessary for those needing to travel internationally while their application is pending, this is included in the filing of I-485.

    Form I-765 (Employment Authorization): This is included in the filing of I-485, allowing applicants to work while they await the final decision on their status.

  • For EB-1A applicants outside the U.S., consular processing involves coordination with the Department of State and may include additional fees based on the U.S. embassy or consulate's specific requirements. This option is vital for those not currently in the U.S. but wishing to obtain permanent residency based on their extraordinary abilities. The processing fee is $345 for this option.

    Affidavit of Support Fee: $120. This fee is paid for processing the affidavit of support form, which is required for most family-based and some employment-based immigrants.

  • Adjustment of Status for Additional Person (Older than 14):

    Legal Fee: $5,000

    Filing Fee: $1,440

    Total Additional Cost per Person: $6,440

    Adjustment of Status for Additional Person (Younger than 14):

    Legal Fee: $5,000
