How to Use the Travel Exemption if they are already on P-1 or O-1 Visa?
If an athlete is in one of the countries that are under a travel ban but already has a valid sports visa such as O-1A or P-1,, they can still try to obtain entry into the United States using the travel exemption for sports. They would need to approach the Customs and Border Patrol Chief with a well prepared 212(f) waiver and flight reservations.
How to use the exemption if the athlete does not have an approved visa?
If the athlete does not have a valid visa that is already stamped on the passport, the process is more hit or miss. We suggest at least applying for a visa to have a receipt notice or an approval notice and coming on an ESTA waiver. They will still probably need a 212(f) waiver along with an explanation of the circumstances and assurances not to receive anything other than prize money during their trip.
