We are elated to report yet another successful P-1 petition. It was on behalf of 3 beneficiaries - Kelvin Arturo Castro Aristides, Frankervil Soriano Acosta, and Jesus Manuel Soriano Ramirez - who form the Essential Support Staff team of exceptional baseball player Miguel Sano. 

Managing Member of the firm, Sherrod Seward successfully presented the petition proving eligibility for the P-1S visa as an Essential Support Staff to USCIS. He provided as many documents as possible for each of the criteria satisfied by the beneficiaries. 

The P-1S Beneficiaries of the MLB Baseball Player

The beneficiaries have all been supporting Sano for the past 4 years in their specialized roles. Aristides served as Sano’s Baseball Hitting Coach, Acosta as his Sports Massage Therapist, and Ramirez as his Strength and Conditioning Trainer. 

Sano is one of the highest touted baseball players in the world. He has P-1 status with The Minnesota Twins of Major League Baseball. His coaching staff is part of his entire baseball training camp preparations. As a team, Sano, with the support of his staff, has risen to become one of the premier players in Major League baseball and competing at the highest level.

The Petitioner

It offers services including developing athletes, mapping out roads to success, contract negotiation.  It also creates marketing and endorsement opportunities, provides financial advice, and helps prepare clients for careers after baseball.

The P-1 Petition 

The P-1S petition was supported by ample evidence that the beneficiaries meet the criteria required for the visa.  

We demonstrated that Mr. Sano is a top-class baseball player, one of the best in the world. He needs specialized training attention and strategic recovery to perform at a world class level for his organization and fans. To earn a living and reach the world championship levels of competition and revenue, especially during COVID-19, he requires his historic and trusted training professional team to maintain fitness in solitude, continue world class production in major league sports, stay safe from COVID-19, and strategize his complete athletic career. We also included information about the importance of self-promotion for combat sports athletes with the petition.

We proved that the beneficiaries have been essential to the seamlessness of Sano’s rise to prominence in Major League Baseball and all over the world, and thereby coveted for their contributions to Sano’s team. We provided sufficient evidence to establish that all the beneficiaries are highly skilled and uniquely calibrated to the physical, psychological, and logistic needs of this world class baseball player. 

We proved that the beneficiaries are highly skilled persons who are integral to the performance of a P nonimmigrant. We provided evidence of the following: 

  1. 4 years of experience in with day-to-day facilitation of physical preparation for the individual sessions of major league baseball training, conditioning, lifestyle, competition, and logistical preparation for the athlete

  2. Letter of support of the beneficiaries’ experience in baseball and work with the beneficiary in the Minnesota Twins facility in the Dominican Republic

  3. Third party confirmation of the MLB schedule that will be repeated in similar fashion over the next 3 years

  4. Evidence of how important direct physical training support is to world class baseball players

We explained why these services cannot be completed by a team in the United States: 

  1. Language Barrier - The P-1S beneficiaries have developed a proven communication style with the beneficiary that is effective and contributes to winning championships. This unique rapport cannot be simulated by any ordinary worker, especially ones that do not speak the Dominican dialect of Spanish. 

  2. Baseball Specialist - Self preparation is very important to the success of baseball athletes. Especially during COVID-19 era. Baseball athletes must shrink and be careful about the people they are around because they can catch COVID-19. This not only stops training but can prevent them from participating in the games. 

  3. The beneficiaries are Dominican baseball style specialists who know how to get the principal visa holder to top shape and provide unique contributions to the Minnasota Twins. Further, special tact is necessary to get into top shape for major league baseball competitions while not getting COVID-19. It is a delicate balance that requires trust and rapport between the baseball player and his trainers. 

  4. Logistical Support - The P-1S beneficiaries are the logistical support for the physical training development. World Class Baseball Players often have several coaches who provide important aspects to training for competition. The beneficiaries will also serve as the logical liaisons between working with all of the specialty coaches. They will coordinate travel in and out of competitions which occur all over the nation. 

We offered statements and independent confirmation for the contributions of the beneficiaries to the performance. We provided a statement from the Principal athlete that explained how and why the contributions are essential. We also provided a letter from the beneficiaries’ management team to confirm and corroborate the essential skills and integral role the P-1S beneficiaries play for the principal beneficiary. 

Thus, we successfully established that the beneficiaries deserve the P-1S visa.
